Yeah well, call it that intuition stuff or whatever. I will be doubly surprised if the 9th Circus doesn't overturn the death penalty. Schatten Posted December 13, 2004 Report Share Posted December 13, 2004 I was pretty surprised when it came down as death, not that he doesn't deserve it but that a California jury would actually reccommend it. They're already talking about appeals and hooya and I agree with ya Gunny that the 9th Circus probably will overturn it at some point, hell they'll probably use it as an excuse to start up the whole "death penalty is cruel and unusual" debate deal all over again. If you ask me, killing your pregnant wife and unborn son is about as cruel and usual as it gets. But even if it all sticks when's the last time California executed someone? Yeah I can't remember either. 20-25 years seems to be the typical sentencing to carrying out the sentence lag out there. And yeah it is quite ironical that San Quentin overlooks the Bay, hope he has some nice scenic walks in the yard and gets to think about things. He was the guy that after a pregnency class with his wife , shot her in the head killing her, and shooting himself in the side and saying that it was caused by a car jacker. The only thing I have to admire about Charles Stuart was that when he knew he was caught, he drove to the top of a very tall bridge and jumped off. Saving the Mass tax payers alot of money. Too bad this A$$hole couldn't be man enough to take his own life when he figured he was caught.... It will take so much money to execute this piece of Sh*t, what a waste.... I did go to jail once, by my own hand. In the little town of Mount Airy, North Carolina. This is the home town of Andy Griffith and the basis for the Andy Griffith Show. The old police station and jail are now open to the public for tourist purposes and there is usually a 1960's era police car with Mayberry police decals sitting in front of the jail. Because he will have extra security in prison, his own cell, etc. If the judge commutes the sentence to life, he will be with the other prison population. Which most don't care for child killers and women killers. Hence the saying, "honor among thieves". Not to mention all the automatic appeals that will cost the taxpayers of California millions of dollars, because he will be given the best defense lawyers free of charge. The 9th Circus has been known to surprise and from what I understand the only folks there in the area that think he's innocent is his family. But I do believe what Schatt said could happen.
