Morning,

Cloudy, foggy, and it might rain.

Had a chat last night with a guy that served on the town council with me. He's in charge of the wood chipping operations for this outfit and is a big cheese in the outfit. They plan on pulling the equipment out this AM and then getting it ready to file a subdivision plan with the town. Now as the major abuttor to this subdivision, I not only have to be given a copy of the plan, but I have the right to offer objections before the planning board.

From the tone of the conversation, it sounds like they want me to be happy, but just haven't decided exactly how they will divide up the land. I do look forward to sitting down and discussing the matter. <_<

I'm sure you will be more than welcome to have you evaluate the plan and even discuss it at meetings, where the developer will tell you to STFU, it's his land and the law says he can do whatever he wants as long as he stays within the local and state codes. That's how it usually goes, although the new board of supervisors in my county have told the developers "no" to new subdivisions as the county cannot afford to build the roads, schools, fire stations, water/sewer lines, etc. to support more housing. The previous board rubber stamped every half-baked idea that was brought before them.

That's kinda what's happened up here too.

The planning board was known to bow to developers wishes. But over the past few years, they have got stricter. One of the nice deals in this whole mess is that while they have access to this parcel, they ONLY have it via the road they built last fall around my land. I own the only undeveloped parcel on the hill that could give them access via another route. Now that road is not up to code. It's not wide enough, nor does it have the required gravel base, fill, etc. In order to bring it up to code they would have to widen it (which they can't because I own the land) and bring in a lot of fill (which would be expensive).

Now I am willing to make a deal, selling them the part of my land that would give them direct access vis the main road, but in return I want that field and part of the woods (what's left of it) directly behind me. I know what they paid for it (per acre) and I know what the land I own down on the main road is worth (about 16x per acre than what they paid for the land behind me), so the only question is how much land and money will change hands.

As for the developer telling me to STFU, they can't. The law up here is quite plain and very abuttor friendly. This is a result of all the development downstate where all the Yuppies live and I intend to take full advantage of it. B)

Oh yea and one other thing, don't forget that I was one of the local officials that wrote the town's Comprehensive Plan (required by State Law), and I damn well know what's in it. I know that and so do they.

And one other point..................my lawyer is a former State AG.

Whew , when you need a break from all that Mane, your still welcome down in Starks to help me pull more wet insulation out. You know historians have learned that the ancient egyptians used wet insulation to help with relaxation after long days working on the pyramids! :P

Damn, this land/developer thing is starting to sound like a plot for a TV series! Maybe "They can have my land over my dead body!" or something. Could you do the updates in installments, Mane? Time to resurrect the "Don't tread on me!" flag, eh?

Two words: imminent domain. The government can seize your land in order to build roads or other public use improvements. Many states now have laws that prevent imminent domain from being used to seize property for purposes of private development, but the law does not protect property owners from the government taking land for government use. So I expect the government can seize whatever strip of your land it wants in order to build a public road.
